Terms and Conditions (T&C)

1. Scope

1.1 These Terms and Conditions (T&C) apply to all contracts concluded between the company [Your Company Name] (hereinafter referred to as "Provider") and the customer (hereinafter referred to as "Customer") for the purchase of jewelry and sweaters, which can be acquired through athletic performance.

1.2 By using the provided services, the Customer agrees to these T&C.

2. Conclusion of Contract

2.1 The contract is concluded when the Customer has successfully completed an athletic performance, qualifying them to receive jewelry or sweaters from the offered range.

2.2 The specific requirements for the athletic performance (e.g., specific distances, achieved points, time targets) are provided on the Provider's website and must be fulfilled before a purchase can be made.

2.3 The order is placed by filling out the online order form on the Provider’s website after the athletic performance has been successfully completed.

3. Prices and Payment Terms

3.1 The prices for jewelry and sweaters are listed on the Provider’s website and include the statutory VAT.

3.2 The Customer agrees to pay the applicable prices at the time of the order. No additional payment is required for the completion of the athletic performance.

3.3 Payment for the products is made, unless otherwise agreed, by confirming the order after the athletic performance is completed. The Customer will receive an invoice via email.

4. Delivery and Shipping

4.1 The Provider will deliver the ordered products within the period specified on the website, unless other arrangements are made.

4.2 Delivery will be made to the address provided by the Customer at the time of ordering. Shipping costs are borne by the Customer, unless otherwise agreed.

4.3 Should the Customer find that the ordered products do not meet expectations after successful ordering and receiving the products, the return provisions of Section 5 apply.

5. Return and Right of Withdrawal

5.1 Jewelry and sweaters acquired through proof of athletic performance are excluded from the right of withdrawal, as they may be custom-made or individually designed based on the Customer's specifications.

5.2 If a product is defective or faulty, the Customer may return the product within 14 days of receiving it and will either receive a replacement product or a refund of the purchase price.

5.3 For returns or claims, the Customer must promptly notify the Provider and return the defective product along with proof of purchase.

6. Liability

6.1 The Provider is not liable for damages resulting from improper use of the products by the Customer.

6.2 The Provider is only liable for damages caused by gross negligence or intent. In cases of simple negligence, the Provider is only liable for the violation of a material contractual obligation.

7. Data Protection

7.1 The Provider is committed to processing and storing the Customer's data in accordance with applicable data protection laws.

7.2 All personal data collected from the Customer in the course of the order process will only be used to fulfill the contract and will not be shared with third parties unless required to fulfill the contract.

8. Prohibition of Resale

8.1 The Customer agrees not to resell the purchased products (jewelry and sweaters) to third parties without prior written consent from the Provider.

8.2 In case of a violation of this provision, the Provider reserves the right to take legal action to claim damages and retrieve the products.

9. Final Provisions

9.1 Any changes or additions to these T&C must be in writing.

9.2 Should any provision of these T&C be invalid, the contract shall remain valid in all other respects. An effective provision that most closely reflects the economic purpose of the invalid provision will replace the invalid provision.
